Welcome to the National Association of Nutrition Educators (the “Association”). These Terms and Conditions (“Terms”) govern your use of our website, online Store, memberships, courses, certification programs, events, and any related services we offer (collectively, the “Services”). By accessing or using the Website or Services, you agree to be bound by these Terms.

Please read these Terms carefully before using the Website or purchasing or participating in any Services. If you do not agree to these Terms, you must not use the Website or Services.

These Terms are intended to be read together with our Privacy Policy and any program-specific policies or agreements referenced on our Certification Programs, Membership, Courses, or Store pages.

Key Definitions

For purposes of these Terms:

  • “Association”, “we”, “us”, and “our” refer to the National Association of Nutrition Educators, the operator of the Website and provider of the Services.
  • “Website” refers to this website and any related pages, subdomains, or online portals we operate.
  • “User” refers to any individual or entity who accesses, browses, or otherwise uses the Website or Services.
  • “Member” refers to any User who has purchased or been granted a membership with the Association.

Use of the Website and Services

Eligibility and account registration. By using the Website or Services, you represent that you are at least the age of majority in your place of residence and have the legal capacity to enter into these Terms. To access certain features (such as purchasing in the Store or accessing member-only content), you may be required to create an account, provide accurate and complete information, and keep your login credentials confidential. You are responsible for all activity that occurs under your account.

Accuracy of information. You agree to provide current, complete, and accurate information when creating an account, enrolling in courses, applying for certification, or purchasing memberships or other products. You agree to update your information promptly if it changes.

Acceptable use. You agree to use the Website and Services only for lawful purposes and in a manner consistent with these Terms. You agree that you will not:

  • Use the Website or Services in any way that violates applicable laws or regulations.
  • Upload, post, transmit, or otherwise make available any Content that is unlawful, harmful, defamatory, obscene, harassing, discriminatory, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to any part of the Website, other users’ accounts, or any servers, systems, or networks connected to the Website.
  • Interfere with or disrupt the operation of the Website or Services, including by introducing viruses, malware, or other harmful code.
  • Copy, scrape, or systematically harvest data or Content from the Website, except as expressly allowed under these Terms.

Suspension or termination. We reserve the right, in our sole discretion and without notice, to suspend or terminate your access to the Website or Services for conduct that we believe violates these Terms, infringes on the rights of others, or is otherwise harmful to the Website, the Association, or other users.

Memberships, Courses, and Certifications

Memberships. Memberships provide access to certain member-only benefits, resources, discounts, and networking opportunities as described on our Membership page. Unless otherwise stated, memberships are personal to the individual or organization and may not be shared or transferred. Membership terms (including duration, benefits, and pricing) are described in more detail on the Membership page and in the Store.

Courses. When you enroll in a course, you receive a limited, non-transferable right to access the course content for your personal or internal professional use, subject to these Terms and any course-specific policies. You are responsible for meeting any technology or participation requirements described on the course page. We may update or improve course content periodically to reflect current evidence and practice.

Certification programs. Certification eligibility, examination requirements, renewal obligations, and any related standards are described on the Certification Programs page and in program manuals or candidate handbooks. We reserve the right to determine eligibility, set passing standards, require ongoing continuing education or renewal, and modify certification requirements over time, in line with professional and quality standards.

Program-specific terms. In some cases, a membership, course, or certification program may include additional or different terms (for example, concerning prerequisites, attendance, or assessment rules). Where there is a conflict between these Terms and clearly stated program-specific terms, the program-specific terms will generally govern for that program, to the extent permitted by applicable law.

Intellectual Property

Unless otherwise indicated, the Website and all Content made available through the Website and Services are owned by or licensed to the Association and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Content for your personal or internal professional purposes only. You may download or print a reasonable number of copies of materials for your own use, provided you retain all copyright and proprietary notices and do not modify the materials.

You may not reproduce, distribute, publicly display, sell, lease, create derivative works from, or otherwise exploit the Website or any Content (including course materials, assessments, logos, and trademarks) for any commercial purpose without our prior written consent, except as expressly allowed in these Terms or in a separate written agreement.

If you submit or upload content (such as discussion posts, feedback, or testimonials) to the Website or Services, you represent that you have the right to do so and grant the Association a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display such content in connection with operating and improving the Services, subject to our Privacy Policy and any applicable data protection laws.

Disclaimers and Limitation of Liability

Educational and informational purposes. The Website, courses, and all related Content are provided for educational and informational purposes only. They are not intended to replace individualized medical care, diagnosis, or treatment, and they are not a substitute for advice from a licensed healthcare professional.

You should always consult with a physician or other qualified healthcare provider before making changes to your diet, supplements, medications, or lifestyle, especially if you have a medical condition, are pregnant or breastfeeding, or are taking prescription medications.

No guarantees. While we strive to provide accurate, up-to-date, and evidence-informed information, we do not guarantee any specific health, wellness, professional, or financial outcomes as a result of using the Website or Services. Your success depends on many factors beyond our control.

“As is” basis. To the fullest extent permitted by applicable law, the Website and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of liability. To the fullest extent permitted by applicable law, the Association and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, arising out of or in connection with your use of the Website or Services. To the extent that we are found liable for any direct damages, our total aggregate liability will be limited to the amount you paid (if any) for the specific Service giving rise to the claim during the twelve (12) months preceding the event that gave rise to the liability, or the minimum amount required by applicable law, whichever is greater.

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

Indemnification and Governing Law

Indemnification. You agree to indemnify, defend, and hold harmless the Association and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Website or Services; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

Governing law and venue. Except where prohibited by local law or where a different governing law is expressly required, these Terms and any disputes arising out of or relating to them or to your use of the Website or Services will be governed by and construed in accordance with the laws of the jurisdiction in which the Association is established, without regard to its conflict-of-laws principles.

Subject to any mandatory provisions of applicable law that require a different forum, you and the Association agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes arising under these Terms.

Where required by applicable law, you may have the right to bring claims in the courts of your place of residence, and nothing in these Terms is intended to limit any non-waivable consumer protection rights.

Changes to These Terms

We may update or modify these Terms from time to time, for example to reflect changes in our Services, applicable laws, or operational practices. When we make changes, we will update the “Last updated” date at the top of this page and post the revised Terms on this Website.

For material changes, we may also provide additional notice, such as by email or by posting a prominent notice on the Website, where appropriate. Your continued use of the Website or Services after the effective date of the revised Terms constitutes your acceptance of the changes.
